BILL NUMBER: A1614
TITLE OF BILL : An act to amend the environmental conservation law,
in relation to the adopt-a-natural resource stewardship program
PURPOSE : This bill shall not allow destruction of natural resources
nor altering such resources in an inconsistent manner with state
policy on preserving such resources. This bill also directs the
Department of Environmental Conservation to provide public notice of
any proposed adopt-a-natural resource stewardship agreement in the
state environmental notice bulletin.
SUMMARY OF PROVISIONS : Amends the Environmental Conservation Law,
by adding a new subsection 4 (b) to S 9-0113 to provide that
adopt-a-natural resource stewardship agreements shall not allow the
destruction of natural resources. Prohibited activities shall also
include, use of heavy equipment to construct, refurbish or build
projects which the professional agency personnel should have the
responsibility for supervising and managing. The agency shall
promulgate new policies based upon this section. Section 9-0113 of
the Environmental Conservation Law is amended by adding a new
subdivision 9 directing the department to provide public notice of any
proposed adopt-a-natural resource stewardship agreement in the state
environmental notice bulletin no later than thirty days prior to final
approval by the department.
JUSTIFICATION : Currently, this law is not specific enough in
regards to who may enter into stewardship agreements for preserving,
maintaining and enhancing natural resources and who will supervise
those groups in the work that they are completing. In some instances,
volunteer groups are being used by the DEC and completing work
unsupervised instead of with the assistance of professional
supervision. These practices are proving to be detrimental to the
natural environment.

EFFECTIVE DATE : This act shall take effect on the one hundred
eightieth day after it shall have become a law; provided that any
rules, regulations and procedures necessary to implement the
provisions of this act on its effective date shall be promulgated,
amended and/or repealed on or before such date.

BILL NUMBER: A1746
TITLE OF BILL : An act to amend the parks, recreation and historic
preservation law and the general municipal law, in relation to
authorizing an adopt-a-park program
PURPOSE : To assist municipalities in obtaining the resources
necessary to maintain municipal parks through community volunteer
services by creating an adopt-a-park program within the department of
parks, recreation, and historic preservation.
SUMMARY OF PROVISIONS : This bill amends Section 277 of the general
municipal law to add a new section 3.27 to expand on the adopt-a-park
program designed to preserve, maintain, and enhance municipality owned
parks. Subdivision 4 of Section 3.09 of the parks, recreation and
historic preservation law is amended to grant the Commissioner of
Parks and Recreation authority to develop regulations to implement the
program.
JUSTIFICATION : Municipalities are often with limited budgets and
strained resources. This bill would provide assistance to
municipalities who obtain technical advice and guidance in organizing
volunteers to "adopt-a-park" that is owned by the municipality.
The "adopt-a-park" program will allow volunteers to cooperate in
projects to maintain and beautify parks such as vandalism remediation,
litter removal, developing and maintaining nature trails, planting and
maintaining flower beds, and otherwise improving the park. A similar
program, the "adopt-a-highway" program was passed in 1985 and has been
very successful in using volunteer services to beautify New York
highways.
