TITLE OF BILL: An act to amend the election law, in relation to the
date for the spring primary for election of electors of president and
vice president of the United States
PURPOSE OR GENERAL IDEA OF BILL: The bill moves the spring primary for
the election of electors of president and vice president of the United
States up one month from March to February.
SUMMARY OF SPECIFIC PROVISIONS:
Section 1: Amends Election Law S 8-100(1)(a) to change the date of the
spring primary for the election of electors of president and vice
president of the United States from March to February.
The change in the date of the primary will result in a change in the
timeframe for circulating and filing presidential petitions. Petitions
could be circulated from October 30 to December 6, 2007 (Election Law
S 6-134{4}) and must be filed with the board of elections December 3
through December 6, 2007 (Election Law S 6-158{1}).
Section 2: Is the effective date.
JUSTIFICATION: Numerous states have moved, or are considering moving,
their presidential primary to an earlier date. Specifically, other
influential states that have similar demographic profiles and similar
public-policy issues to New York State`s are contemplating shifting
their primaries to February 5. A similar change will give New Yorkers
an early voice in the selection of the best presidential candidates
for the state and the nation and will reflect New York`s impact on and
importance to our nation.
